Volunteer Waiver, Liability Release and Covenant Not to Sue

I hereby waive and release each of the Organizations, individually and collectively and their respective directors, officers, employees, interns, contractors, consultants, volunteers, agents, successors and assigns from any and all claims, demands, causes of action or suits at law or equity in any way arising out of or relating to my Volunteer Services. This waiver and release is intended to and does include any and all claims, demands, causes of action or suits at law or equity arising out of or relating to negligence.

I covenant and agree not to institute any claim, demand, cause of action or suit at law or equity against the Organizations, individually or collectively, their respective directors, officers, employees, interns, contractors, consultants, volunteers, agents, successors and assigns arising out of or relating to my provision of Volunteer Services.

I understand and agree that the Organizations, their respective directors, officers, employees, interns, contractors, consultants, volunteers, agents, successors and assigns assume no responsibility or obligation to provide me with financial or other assistance, including but not limited to, medical, health or disability benefits or insurance of any kind or nature in any event, including but not limited to, my injury, illness or death or damage to my person or property. I understand that the Organizations do not carry or maintain health, medical, or disability insurance for any Volunteer. Each Volunteer is expected and encouraged to obtain his or her own medical or health insurance coverage. I expressly waive any and all claims for compensation, benefits or any other type or form of remuneration in any way relating to my Volunteer Services.

I hereby Release and forever discharge the Organizations, individually and collectively and their respective directors, officers, employees, interns, contractors, consultants, volunteers, agents, successors and assigns from any and all claims and liabilities which arise, or may hereafter arise, in any way related to any first-aid or other medical treatment or service(s) rendered in connection with my Volunteer Services.

I understand that the volunteer services I provide to the Organizations, individually or collectively,  may include activities that may be hazardous to me or expose me to physical or mental risk(s), including but not limited to, inherently dangerous activities. For good and valuable consideration, described above, I hereby expressly assume all risks of harm, including but not limited to physical, mental and emotional harm, from any and all Volunteer Services.

I grant to the Organizations individually and collectively and their respective authorized representatives the right and permission to use and create photos, video, film, audio, other recordings, transcriptions, copies, presentations or other material regardless of whether created by LDF, PPC, Forward Justice, or another source related to the Volunteer Services described herein (collectively, the “Authorized Recordings”) of me that may include my voice, image, likeness, name, signature, actions, appearance, biographical information and statements (collectively, “Likeness”) in in any manner and in any media, now known or later developed, throughout the world, at any time without review, permission or compensation of any amount or kind whatsoever, for the purpose of the Organizations, individually or collectively, conducting their business activities, including but not limited to advertising, publicizing, fundraising, and solicitation purposes.

The Organizations, individually and collectively, shall have complete ownership of all Authorized Recordings, including copyright interests, and I acknowledge I have no interest or ownership in the Authorized Recordings (or any portion thereof) or its copyright. I hereby grant the Organizations, individually and collectively, and their respective licensees, successors and assigns (collectively, the “Licensees”) an unconditional, irrevocable, royalty-free right and license to publish, reproduce, distribute, edit, display and otherwise use and exploit my Likeness, in any manner, in and in connection with the Authorized Recordings (in whole or in part) and derivative works thereof, together with any other material, edited or altered as the Licensees see fit, in perpetuity, in any media (now known or hereafter invented), throughout the world, in any language, and for any purposes whatsoever, including, without limitation, for advertising, promotion and trade purposes, all as the Licensees shall determine in their sole discretion. I further grant Licensees the same license any other photographs, images, video, and/or audio that is created, which relates in any way to my Volunteer Services. Without limiting the generality of the foregoing, Licensees shall have the right to broadcast video and audio podcasts of a recording of me on their websites and other social media platforms (such as YouTube.com), or TV or radio, or at events. I grant the Licensees the right, without notice to me, to transfer, assign or sublicense their rights under this Release to any third parties who may exercise the same rights as the Licensees are authorized to do pursuant to this Release.

I shall have no right of approval, no claim to compensation, and no claim (including but not limited to any claims of defamation, invasion of privacy, violation of the right of publicity, or copyright or trademark infringement) arising out of the use, alteration, distortion, illusionary effect, fictionalization, or use in composite form of my Likeness and I hereby release the Organizations individually and collectively and their respective licensees, successors and assigns from any such claim.

I grant the “Photographic, Video and Audio Release” described above without any expectation of monetary or other compensation now or in the future, and only for the intangible consideration described above. I understand that the Licensees are under no obligation to exercise any of the rights granted herein.

I understand that the Organizations are separate nonprofit, non-partisan organizations and agree that all my Volunteer Services with the Organizations must, at all times and in all ways, be conducted in a non-partisan manner.

While providing Volunteer Services to the Organizations, individually or collectively, I agree to conduct myself in a reasonable and responsible manner and will refrain from engaging in inappropriate or illegal conduct, including but not limited to harassment – whether sexual or otherwise – or any other offensive conduct.

As a volunteer, I expressly agree that this Agreement is intended to be as broad and inclusive as permitted by law. I understand and agree that in the event any clause or provision of this Agreement is deemed invalid, the enforceability of the remaining provisions shall not be affected and shall remain in full force.

I understand and agree that the Organizations, individually or collectively, may, in their sole discretion, terminate my Volunteer Services at any time for any reason, or for no reason at all.
